Terms and Conditions

Scope

These terms and conditions apply to all purchases made from VEGAN EMPIRE GmbH by private customers. Private customers within this meaning are persons whose place of residence and delivery address are in a country we deliver to in accordance with our shipping terms, provided the goods ordered can be attributed neither to their commercial nor to their self-employed professional activity.

Prices and shipping costs

All prices shown are final prices including statutory VAT. The amount shown at the time of the binding order applies.

Shipping costs are added; they depend on the shipping method as well as the size and weight of the goods ordered. You can find the details in the shop.

You bear the cost of returning the goods in the event of a withdrawal. In addition to the value of the goods, we will also refund the original shipping costs, with the exception of supplementary costs arising from your choice of a delivery type other than the least expensive standard delivery.

Payment

Payment is made before dispatch using the payment methods offered in the shop, including:

Default of payment

If you are in default of payment, VEGAN EMPIRE GmbH is entitled to demand default interest of 5 percentage points per year above the base interest rate published by the Deutsche Bundesbank at the time of the order.

If we incur a higher loss caused by the default, we may assert it.

Right of retention

You are entitled to exercise a right of retention only to the extent that your counterclaim is based on the same contractual relationship.

Delivery

Delivery is made to the delivery address you provide, within the delivery areas stated in the shop.

If force majeure (e.g. natural disasters, war, civil war or terrorist attacks) makes delivery or any other performance permanently impossible, the obligation to perform ceases to apply. We will refund any amounts already paid without undue delay.

We may also refuse performance where it would require an effort that, taking into account the content of the purchase contract and the requirements of good faith, is grossly disproportionate to your interest in performance. In this case, too, we will refund any amounts already paid without undue delay.

Returning the goods

When returning goods, please use the original packaging where possible, even if it has already been opened.

On request we will provide you with a return label. Unless the return is due to a defect in the goods, the cost of the return label will be deducted from your refund amount.

Specifics of print-on-demand

Most of our products are made using print-on-demand. This means that each product is manufactured individually only after you have placed your order.

Standard products (e.g. sports bras, T-shirts, hoodies or other items carrying our predefined designs and motifs) do not legally count as personalised one-off items. Your statutory right of withdrawal under section 312g of the German Civil Code (BGB) applies to these. You can return them within 14 days, bearing the return shipping costs yourself.

Personalised products (e.g. carrying your name, individual text or custom motifs) are excluded from withdrawal. A return is not possible in these cases, because the goods have been clearly tailored to your personal requirements (section 312g(2) nos. 1 and 3 BGB).

Retention of title

The goods delivered remain the property of VEGAN EMPIRE GmbH until all claims against you arising from the purchase contract have been settled in full.

As long as this retention of title applies, you may neither resell the goods nor otherwise dispose of them.

Rights in the event of defects (warranty)

If a product is already defective on delivery, we will provide subsequent performance by way of replacement or repair, at your choice.

There is no warranty claim for damage caused by improper use or external influences.

The statutory warranty period is two years from delivery.

Product safety (GPSR)

All products we offer comply with the applicable requirements of EU product safety legislation.

Liability

We are liable without limitation for damage arising from injury to life, body or health, and in cases of intent and gross negligence.

In the case of slightly negligent breach of material contractual obligations, we are liable only for the foreseeable damage typical of the contract. Material contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.

Otherwise liability is excluded to the extent permitted by law.

Liability under the German Product Liability Act remains unaffected.

Applicable law

The contract is governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.

Place of jurisdiction

For consumers, the statutory places of jurisdiction apply.

Dispute resolution

The European Online Dispute Resolution platform (ODR platform) was discontinued on 20 July 2025 and is no longer available.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
